Introduction
Magicz Online Solutions is concerned about the privacy rights of its clients, visitors to its Web sites (“Site”) and the security of their data. Accordingly, we have adopted this Privacy Policy for this Site to ensure responsible use of the information you share with Magicz Online Solutions and to make you aware of the terms and conditions of your use of this Site and our services. We may at any time revise this Privacy Policy by updating the Site. You are bound by any such revisions and should therefore periodically visit this page to review the then current Privacy Policy. This Privacy Policy is incorporated by reference into Magicz Online Solutions' client agreements. In the event any provisions contained in this Privacy Policy conflict with any terms, conditions or clauses contained in an agreement between you and Magicz Online Solutions, the provisions of the agreement shall govern. As used herein, the term “Magicz” includes any and all divisions, affiliates and subsidiary companies of Magicz Online Solutions, if any.

Types of Information Collected
Traffic Data CollectedWe automatically track and collect the following information when you visit our Site, including your: (i) IP address; (ii) host name; (iii) computer operating system; (iv) requested page; (v) referring URL; (vi) time of visit; and (vii) type of web browser (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving a visitor’s experience on the Site.

CookiesMagicz uses “cookies” in providing services and to enhance your experience on the Site. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to enable our systems to recognize your browser in order to do a number of things, including but not limited to, customize content specific to your interests, ensure that you do not see the same advertisement repeatedly and to store your password so you do not have to re-enter it each
time you visit the Site. The “help” portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. However, cookies allow you to take full advantage of Magicz’s Site and services.
Uses of Information Collected
Magicz uses the Personal Information it gathers to assist us with providing you the best online experience possible. We use Contact Data to send information about our company and services, or promotional material from some of our partners, or to contact you when necessary about the services we provide you. We reserve the right, in our sole discretion, to send bulletins and other important information to you. We use your Financial Data to verify your qualifications for certain services and to bill you for services. We use your Demographic Data to gather general interest in our services, to help in the analysis of service usage, purchasing and target markets. Domain name customers who have registered a domain name with Magicz and wish to change the Technical Contact to another company, may do so by contacting domains@magicz.com. It is important to note that customer domain name registration information is made publicly available in the registry of domain names.
Sharing of Personal Information
We share Traffic Data, Demographic Data and Contact Data with selected partners, for example, to provide you with information about products or services which might be of interest to you or to enable you to take advantage of special partner programs. As we continue to develop our business, we might buy or sell additional assets. In such transactions, Personal Information generally is one of the transferred business assets. Also, in the event that Magicz, or substantially all of its assets are acquired, Personal Information will of course be one of the transferred assets. In very limited circumstances, we may also release your Contact Data to system administrators at other sites if we reasonably believe there
is a violation of system security relating to such site that originated from our servers. Of course, we will also fully cooperate with law enforcement authorities in investigating suspected lawbreakers.
User Choice Regarding Collection, Use and Distribution of Personal Information
You may choose not to provide us with any Personal Information. In such an event, you can still access and use some of the Site; however you will not be able to access and use those portions of the Site that require your Personal Information and you will not be able to purchase services from us. However, users may not “opt out” of receiving information from Magicz which is related to maintaining or updating client accounts and system information or our release of Contact Data pursuant to court orders or criminal investigations.
Confidentiality and Security of Personal Information
Except as otherwise provided in this Privacy Policy, we will use commercially reasonable efforts to keep your Personal Information private but it will be necessary to disclose such information to: (a) protect our rights or property; or (b) enforce this Privacy Policy or any agreement between you and Magicz.
Your Personal Information is stored on servers that are generally not accessible by third parties and a minimal number of our employees have access to your Personal Information. All Financial Data is transmitted using Secure Sockets Layer (SSL) protocol, which encrypts your information and confirms the identity of the Magicz server before completing the transaction. To ensure you that such information is secure, look for the picture of the unbroken key or closed lock in your browser window. Either indicator means SSL is hard at work. Another way you can tell if SSL is guarding your transaction is to check the URL of the website. It should change from “http” to “https” when processing secure
transactions.

Use of the Site
The Site is owned and operated by Magicz Online Solutions. No materials found on the Site or any other site owned, operated, or licensed by Magicz may be copied, reproduced, republished, uploaded, posted, transmitted or distributed in any way except as expressly provided by Magicz. You may not distribute, modify, transmit, reuse, repost or use the content of the Site without Magicz's prior permission. Magicz neither warrants nor represents that your use of materials displayed on the Site will not infringe rights of any third party. Because of the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content, including all laws, rules, codes and regulations of the country in which you reside.

If you use any links provided in the Site to Web sites not owned, maintained or hosted by Magicz (“Off-Sites”), you will leave the Site. Magicz is not responsible for any
Off-site's privacy policies or terms of use. No warranty is made with respect to the accuracy, timeliness, or suitability of the content of any Off-Sites, and Magicz takes no responsibility for such sites. A link to an Off-Site is not an endorsement of the Off-Site, its content, or its sponsoring organization.
Limitation of Liability
Under no circumstances, including but not limited to negligence by act or omission, shall Magicz or any party involved in creating, producing, or delivering the Site or its content, be liable for any direct, incidental, consequential, indirect or punitive damages that result from the use of, or the inability to use the materials on the Site, even if Magicz or a representative authorized by Magicz has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event, however, shall Magicz's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the Site.
Jurisdictional Issues
Your use of the Site, and the terms of this Privacy Policy, shall be construed and controlled by the laws of the United States, and specifically, the State of Missouri, except as it relates to conflict of laws. Further, any dispute arising from your use of this Site or the terms of this Privacy Policy, or a breach thereof, shall be governed by the laws of the State of Missouri. By accessing the Site, you agree to personal jurisdiction by the state and federal courts sitting in the State of Missouri, County of Jackson. The sole and exclusive jurisdiction and venue for any and all disputes regarding your use of the Site shall be the state or federal courts located in the State of Missouri, County of Jackson.
Copyright Complaints
Magicz may, in appropriate circumstances and at its sole discretion, terminate use of the Site by any visitors who infringe on the intellectual property rights of others.
If you believe that your work has been copied in a way that constitutes copyright infringement, please provide Magicz's Copyright Agent the following information:
(1) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
(2) a description of the copyrighted work that you claim has been infringed;
(3) a description of where the material that you claim is infringing is located on the Site;
(4) your address, telephone number, and email address;
